Bid to reject damages claim in rape case

A disabled alleged rape victim should be stopped from suing police over their investigation of her case, the High Court heard yesterday.

Lawyers for the PSNI are seeking to have the lawsuit struck out, claiming no duty of care breach has been established.

A Police Ombudsman report identified failings in how officers handled her complaint. The woman, who cannot be identified, said she was raped in Londonderry in 2007.

Detectives took six months to interview her after she reported the incident. Police failed to seize CCTV evidence or carry out house to house inquiries to seek witnesses.

The woman is seeking damages for negligence. Judgment was reserved.
